Artist Agreement

Draft for legal review. Version 2026-10.

This agreement is between you (the “Artist”) and the operator of posterdatabase.com (“PosterDatabase”, “we”). By opening a shop you accept it.

1. What we provide

We provide an online marketplace where you can list digital artwork for buyers to purchase and download. You are the seller of each artwork you list. We provide the website, checkout, secure file delivery and an Artist Hub.

2. Your rights to the artwork

You may only list work that (a) you created, (b) you are licensed to sell as a digital download, or (c) is in the public domain in the countries where it is sold. You confirm this each time you publish. Age alone does not make a work public domain: many vintage posters, photographs, film and music artwork remain protected by copyright or trademark. You must keep evidence of your rights and provide it to us on request.

You keep ownership of your work. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce (including as resized previews), display and promote your listings, and to deliver the files to buyers, for as long as the work is listed and afterwards as needed to honour past purchases.

3. Buyer licence

Unless your listing says otherwise, buyers receive a personal, non-commercial licence to download, view and print the artwork for their own use. They may not resell or redistribute the file.

4. Prohibited content

You must not list work that infringes anyone’s rights; impersonates another artist or brand; is sexually explicit, hateful, violent or illegal; contains malware; or is misleading about its origin, age, authenticity or rights status.

5. Prices, commission and fees

You set your prices. For each completed sale we keep a commission of 10% of the product price (excluding taxes collected separately), plus an automatic relisting fee of $0.15 (US dollars, or the equivalent in the sale currency at the rate shown in your sales records) for each unit sold. Your artwork stays on sale after every purchase; nothing needs relisting by hand. Both amounts are deducted from the payment before it reaches your Stripe balance.

5a. Plans and listings

The free plan includes 100 new artwork listings in each 6-month period, counted from your registration date. Unused free listings expire at the end of each period and do not carry over. A listing is used when an artwork is first published; editing, repricing, unpublishing and republishing do not use another, and deleting artwork does not return one. Published artwork stays online whichever plan you are on.

The paid membership costs $30.00 per year, renews automatically until cancelled, and is billed by Stripe. Members keep the free allowance and can publish additional artwork at $0.15 per new listing, bought in advance as prepaid listing packs that do not expire. Commission and the relisting fee are the same on both plans. If a membership ends, you return to the free plan; nothing is unpublished. Membership fees and listing packs are non-refundable except where required by law.

Payments are processed by Stripe directly into your own Stripe account. Stripe’s processing fees, currency conversion fees and any instant-payout fees are charged by Stripe to your account and are not part of our commission. Stripe pays out to your bank on your account’s schedule. You must accept Stripe’s Connected Account Agreement.

6. Refunds and chargebacks

We may refund buyers where a file is faulty, not as described, or where required by law. Refunds are deducted from your Stripe balance and we return our commission in proportion. You are responsible for chargebacks on your sales and may respond to them through Stripe. If a chargeback is lost, we return our commission on that sale. Stripe may charge dispute fees.

7. Taxes

You are responsible for your own income taxes and for any sales tax or VAT you are required to charge or account for as the seller, unless we tell you in writing that we collect and remit a particular tax on your behalf.

8. Complaints and takedowns

If we receive a complaint about your artwork, we may remove it from sale while we investigate and will tell you. You may respond with evidence. We may permanently remove artwork or close your shop if we reasonably believe it infringes rights or breaks this agreement. Buyers who purchased it before removal keep access to their download.

9. Suspension and closure

You may close your shop at any time. We may suspend or close a shop for breach of this agreement, fraud, repeated infringement complaints or legal requirement. Sales completed before closure are not affected.

10. Data

We handle personal data under our Privacy Policy. We do not share buyers’ contact or payment details with artists; we share only what is needed for tax and support, such as the buyer’s country.

11. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability to you is limited to the commission we received from your sales in the previous 12 months. You will reimburse us for losses caused by your breach of section 2 or 4.

12. Changes

We may update this agreement with at least 14 days’ notice by email. Continuing to sell after that date means you accept the update.
